1.
Definitions
In this contract, “Client”, “you” and “your” mean or refer to
each person who has signed the contract as a client;
“Shaarey Zedek”, “the synagogue”, “the premises”, “we” and “our”
mean or refer to Congregation Shaarey Zedek;
“Current” or “prevailing” rates mean the rates in effect on the
date of contract;
“Final function deposit” means the amount required to have been
paid prior to the function;
“Shabbat” means the period between sundown on Friday and sundown
on Saturday;
“Kashrut” or “Kosher” means the standards prescribed by
Congregation Shaarey Zedek as interpreted and defined by its
senior Rabbi;
“MLCC” means the Manitoba
Liquor Control Commission or any body charged with the
responsibility for issuing liquor permits;
“SOCAN” means Society of Composers, Authors and Music Publishers
of Canada or such other body that is legally designated to
collect royalties.
2.
Deposit
When you book your function, you will be required to pay a
deposit of $500.00 one year prior to your scheduled date.
Approximately three weeks prior to the function, you will be
required to finalize and sign the food contract and pay a ninety
percent (90%) deposit of all estimated charges.
All balances are due not
later than seven (7) days after the function.
3.
Guaranteeing the
Number of Guests
You are required to guarantee the number of guests not later
than ten (10) days prior to the function. If we do not receive
your confirmation, then the number of guests stated in this
contract will be deemed to be guaranteed by you. Upon your
request, we will prepare for five percent (5%) more than the
guaranteed number. In that case, you will be charged for the
guaranteed number or the actual number, whichever is greater.
4.
Removal of Food
Food prepared by the Shaarey Zedek Catering Department may not
be removed from the Synagogue except for those items charged on
a per unit/item basis, or items ordered separately from an
acceptable outside kosher caterer.
5.
Cancellation
These are the cancellation fees, which will apply whether or not
the prevailing rental was earlier waived:
a.
If we receive your written notice of
cancellation of your function earlier than twelve (12) months
prior to the function, fifty percent (50%) of the deposit will
be retained;
b.
If we receive your written notice of
cancellation less than twelve (12) months prior to the function
date, one hundred percent (100%) of the $500.00 deposit will be
retained.
6.
Gratuity
A gratuity of fifteen percent (15%) is reflected and specified
in this contract. The staff of Congregation Shaarey Zedek
expects no further gratuity.
7.
Alcoholic
Beverages
No alcoholic beverages are permitted on the premises of
Congregation Shaarey Zedek without a valid MLCC permit. You are
responsible for obtaining the appropriate permit. Your permit
must be presented in advance of the function for approval of the
Executive Chef. All MLCC regulations include the requirement for
compliance with all laws of Winnipeg, Manitoba and Canada.
With the exception of table wine, a professional bartender must
serve all alcoholic beverages. |
8.
Bringing Food and
Beverages to the Synagogue
You may not bring food and/or beverages into the synagogue other
than those supplies required for your baking day. We require
that you undertake all measures that will ensure that the rules
of Kashrut are observed. Our senior
Rabbi will be available to
answer any questions you may have.
A breach of the standards of Kashrut will result in removal of
food and/or beverages immediately. If you are unavailable to
receive what was removed, it will be delivered to Winnipeg
Harvest at your expense.
9.
Storage and
Delivery of Food and Beverages
Our storage space is limited. Storage arrangements must be made
in advance with the Executive Chef. Out of respect for Shabbat
and Holy Days, any delivery must be completed by 3:00 PM on
Friday or the day preceding a holiday. Deliveries arriving after
3:00 PM on those days will not be accepted. Similarly, nothing
may be removed from the Synagogue on Shabbat or a Holy Day.
10.
Important
Liability Notice
We cannot and do not assume liability for acts of God or acts
beyond our control.
We cannot and do not assume liability for food and/or beverages
served at your function which were not prepared or obtained by
us. Similarly, we cannot and do not assume liability for any
product produced for consumption on our premises that has
subsequently been removed.
11.
Your Liability
You agree to take responsibility for any damage done to the
premises or removal of synagogue property by you, your guests,
employees, independent contractor or agents. If a claim is made
against the synagogue arising from your use of the premises, you
agree to protect us from any such claim and
to indemnify us for any cost,
which we may incur in that regard.
You agree to provide us with a list of those with whom you
contract for goods and/or services, including the names of those
in charge and their telephone numbers.
You also agree to be responsible for the proper supervision of
all persons under the age of eighteen (18) years who may be on
the premises during your function.
12.
Entertainment
You must obtain our written approval of any entertainers or
recorded music players whom you engage and you must be able to
tell us what equipment will be used on the premises. We reserve
the right to control the level of noise at any function and
require you to provide the instruction to whomever you hire.
You agree to be responsible
for payment of any fees to SOCAN as a result of music performed
or played at your function.
Musical performances are not permitted on Shabbat.
13.
Timing
You agree to commence your
function at the time specified in this contract and to take all
necessary steps to conclude it by the time specified at the end
of the function. If we are required to pay overtime wages or
costs as a result of a delay in the closing of the function,
then you agree to reimburse us for wages or other expenses
incurred as a result of the delay.
14.
Smoking Policy
Smoking is not allowed on the premises.
15.
Membership
Obligation
Clients who are members of
Congregation Shaarey Zedek must not have past due financial
obligations to the synagogue. If arrears exist within sixty (60)
days of the date of a function, the synagogue may cause the
function to be cancelled. In that case, Section 4 of the
contract relating to cancellation fees will apply. |
